Terms of Service

Welcome to Ode. By placing an order or using odesongs.com (the “Service”), you agree to these Terms of Service. Please read them; they're written in plain English.

1. What Ode is

Ode is a personalized AI song gifting service. You provide details about the recipient: their name, your shared memories, the occasion, and a preferred musical style. We use AI (Claude by Anthropic for lyrics, ElevenLabs for music) to generate a unique song delivered digitally. Optional physical add-ons (keepsake books, plaques, cards) may be available at checkout and fulfilled by third-party print partners.

2. Placing an order

• You must be 18 or older to place an order.
• All prices are in USD and include applicable taxes where Dodo Payments (our Merchant of Record) is required to collect them.
• Your order is confirmed when payment is successfully processed. You will receive a confirmation email with your order details.
• Song generation begins automatically after payment and is typically complete within a few minutes.

3. Song ownership and licence

Once your order is complete and payment has cleared, you own the song delivered to you. Specifically:

• Your licence: We grant you a perpetual, non-exclusive, worldwide licence to use, share, and enjoy the song and lyric video for personal, non-commercial purposes, including gifting it, posting it on social media, and playing it at events.
• Commercial use: If you want to use the song commercially (e.g., in an advertisement, film, or sold product), contact us at hello@odesongs.com to discuss a commercial licence.
• Our rights: Ode retains the right to display your song (anonymised or with permission) as an example of our work and to use it to improve our AI models, unless you opt out by emailing us.
• AI-generated content: Because the song is AI-generated, copyright status may vary by jurisdiction. We make no warranty that the song will be protectable by copyright in your location.

4. Refund and regeneration policy

We want you to love your song. Our policy:

• 30-day regeneration guarantee: If you are unhappy with your song within 30 days of delivery, email us and we will regenerate it at no extra charge. You can request one regeneration per order.
• Full refund: If your song fails to generate due to a technical error on our side and we cannot resolve it within 48 hours, you are entitled to a full refund.
• No refund for completed songs: Once a song has been successfully generated and delivered, we do not offer refunds on the digital song itself. AI generation costs are incurred at the time of generation. If you are unhappy, please use the regeneration guarantee above.
• Physical add-ons: Physical products (keepsake books, plaques, cards) are made-to-order and are non-refundable once production has begun, unless they arrive damaged or defective. In that case we will replace them at no cost.

5. Acceptable use

You agree not to use Ode to create songs that contain or request:

• Hate speech, discrimination, or content targeting people based on race, gender, religion, or other protected characteristics
• Content that sexualises or targets minors
• Harassment, threats, or content intended to harm a specific person
• Content that facilitates or promotes illegal activity
• Defamatory content about real, identifiable individuals
• Content that impersonates another person or entity in a misleading way

We reserve the right to refuse or cancel orders that violate these guidelines. If we discover a violation after generation, we may terminate your access to the Service and report to relevant authorities where required by law. No refund will be issued for orders cancelled due to acceptable use violations.

6. User-generated content

If you submit content to Ode beyond your song order, such as testimonials, reviews, photos, or other creative material through any submission feature (“UGC”), you grant Ode a perpetual, irrevocable, royalty-free, worldwide licence to use, reproduce, modify, distribute, and display that UGC in connection with our marketing, products, and services. You retain ownership of your UGC and represent that you have the right to grant this licence.

7. Intellectual property

The Ode name, logo, website design, and all underlying technology are the intellectual property of Ode Songs Inc. You may not reproduce, distribute, or create derivative works of our brand assets or technology without our prior written permission.

8. Disclaimer of warranties

The Service is provided “as is”. While we work hard to deliver a high-quality song every time, AI generation is inherently creative and unpredictable. We do not warrant that any specific lyrical content, musical style, or emotional tone will be achieved. Our regeneration guarantee (Section 4) is your remedy if you are dissatisfied.

We do not warrant that the Service will be uninterrupted or error-free. Temporary outages may occur due to maintenance or third-party service disruptions.

9. Limitation of liability

To the maximum extent permitted by law, Ode's total liability to you for any claim arising from your use of the Service is limited to the amount you paid for the order giving rise to the claim.

Ode is not liable for any indirect, incidental, consequential, or punitive damages, including lost profits, loss of data, or emotional distress, even if we have been advised of the possibility of such damages.

Some jurisdictions do not allow the exclusion of certain warranties or limitation of liability. In such cases, our liability is limited to the fullest extent permitted by applicable law.

10. Governing law

These Terms are governed by and construed in accordance with the laws of the State of Delaware, without regard to its conflict of law provisions. Any disputes arising from these Terms or your use of the Service shall be subject to the exclusive jurisdiction of the state and federal courts located in Delaware.

11. Changes to these Terms

We may update these Terms from time to time. When we do, we will update the “Last updated” date at the top. For material changes, we will notify you by email. Continuing to use the Service after a change constitutes acceptance of the updated Terms.
